Terms of service

Flo Dynasty offers web design, branding, graphic design, digital marketing, content creation, videography, and related consulting services, as well as digital products (templates, guides, etc.).  All work is now provided on a per‑quote, project basis. Each project scope will be defined in a written quote or proposal (“Service Agreement”).

• Right to Decline: We reserve the absolute right to accept or decline any request for services, project proposals, or plan enrollments at our sole discretion.

• Availability: All services and potential subscription plans are offered strictly “by availability” and are not guaranteed. We may close enrollment or decline new projects based on current capacity.

• Scope: The specific scope of work will be defined in a written quote or proposal (“Service Agreement”).

All projects require an approved quote and may require a deposit to commence work.  Full payment is due upon completion unless otherwise stated in your Service Agreement.  If payment is not received by the due date, we may suspend services.

• Methods: We accept payments via PayPal and other methods listed on our invoice.

• Fees: You are responsible for the full payment amount.

• No Recurring Billing: We do not currently offer auto-renewing subscription plans. Each project is billed separately.

Our Refund Policy is incorporated herein by reference.  If you cancel a project before work has begun, you may be eligible for a full refund of any deposit.  Once work has started, refunds are at our discretion and may be prorated based on the work completed.  We reserve the right to cancel or decline service requests.  If we cancel a project without delivering the agreed deliverables, we will refund any payments received for the unfulfilled portion.  See the Refund Policy for full details.

• Processing Fees: If a refund is issued for any reason, transaction fees charged by payment processors (e.g., PayPal, Stripe) are non-refundable. The refunded amount will be calculated net of these fees.

• Cancellation: We reserve the right to cancel any project at any time. If we cancel without cause, a refund for uncompleted work will be issued (less processing fees).

All materials created by Flo Dynasty remain our property until full payment is received. Upon payment, usage rights transfer to the client as defined in the Service Agreement. You may not resell or claim authorship of our work without written permission. See our Link to Digital Item Policy for details on templates.

As-Is: Our services are provided “as-is” without warranties of any kind.

Cap on Damages: Flo Dynasty’s total liability for any claim arising out of these Terms or our services shall not exceed the total amount you have actually paid to us for the specific project giving rise to the claim.

Exclusion of Personal Liability: You agree that you will look solely to the business assets of Flo Dynasty for the satisfaction of any claim and waive the right to pursue the personal assets of the owner.

No Consequential Damages: We are not liable for lost profits, data loss, or third-party platform outages (e.g., Wix, PayPal).

Clients must provide accurate info, timely feedback, and necessary access (logins, content). Delays caused by the client may result in project rescheduling or additional fees.

You agree to indemnify, defend, and hold Flo Dynasty and its owner harmless against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from your use of the Services, your breach of these Terms, or your violation of any third-party rights.

Either party may terminate a project with written notice if the other party breaches these Terms or the Service Agreement.  You remain responsible for payment for all work completed up to the termination date. We reserve the right to terminate or refuse future services to clients who fail to pay, breach these Terms or behave abusively.

These Terms are governed by the laws of the U.S. Virgin Islands. You agree to submit to the exclusive jurisdiction of the courts located in the U.S. Virgin Islands.
